Importance of Screening

Information for Childcare Providers

Vermont rules for childcare providers require that anyone providing childcare in a building built before 1978 must adhere to Vermont’s Essential Maintenance Practices (EMP) law. The EMP law requires a certain standard of care in regards to maintenance of lead painted surfaces. Specific requirement for EMPs for childcare in pre-1978 buildings are as follows:

Essential maintenance practices shall be performed prior to initial licensure and at least annually thereafter in the space defined as licensed space. Essential maintenance practices shall be performed by a person who has been certified by the Vermont Department of Health, or is supervised on-site by a person certified by the Vermont Department of Health to perform essential maintenance practices. Essential maintenance practices shall include:

  1. Installation of aluminum coil stock window well liners in all wooden window wells.

  2. Visual inspection of interior painted surfaces in the facility areas accessible to children to identify deteriorated paint.

  3. Use of safe work practices to stabilize or repair deteriorated paint if more than one square foot of deterioration is found and performing specialized cleaning at the conclusion of any work.

  4. Visual inspection of all exterior surfaces of the building to which children have access to identify deteriorated paint.

  5. Use of safe work practices to stabilize or repair deteriorated paint if more than one square foot of deterioration is found.

  6. Blocking access to ensure children will not come into contact with deteriorated paint if the deteriorated paint was identified after November 1st, but will be fixed by May 31st.

  7. Performing annual specialized cleaning in common areas of the building to which children have access.

  8. For any outdoor area, removing all visible paint chips from the ground on the property.

  9. Posting a notice in the childcare facility that encourages individuals to report deteriorated paint to the owner or owner's agent.

  10. The owner of the premises of a childcare facility shall file an EMP compliance statement annually by the due date with the Childhood Lead Poisoning Prevention Program of the Vermont Department of Health and provided copies to the Vermont Department for Children and Families, the licensee's liability insurance carrier, and with any tenant of the facility.
